Liability, Assumption of Risk, and Insurance. Illumina, the Event Venue, the Event Venue’s official appointed agencies for Registration, and any suppliers, representatives, or agents linked to the organization of the Event shall not be held liable by any person for any injury, damage, theft, loss, medical problem, or inconvenience which may be suffered by any person while traveling to or from, or during such person’s presence in connection with this Event. Participants and their guests are advised to purchase their own insurance against any such occurrences. Participation in and attendance of the Event is completely voluntary. Participants accept and assume all risks of any damage to personal property or for personal injury that they may face while attending the Event. Participants understand that by registering for the Event, they give up the right to bring any potential claim to seek damages, whether known or unknown, foreseen, or unforeseen. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARTICIPANTS HEREBY ACKNOWLEDGE AND KNOWINGLY, VOLUNTARILY, IRREVOCABLY, AND FOREVER RELEASE, WAIVE, AND DISCHARGE ILLUMINA FROM ANY AND ALL LIABILITY FOR DAMAGES OR INJURIES ON ACCOUNT OF OR IN ANY WAY RELATED TO OR ARISING FROM THE EVENT, WHETHER DUE TO PARTICIPANT’S NEGLIGENCE, THE NEGLIGENCE OF THIRD PARTIES, OR ILLUMINA’S NEGLIGENCE. PARTICIPANT HEREBY ACCEPTS PERSONAL RESPONSIBILITY FOR ITS VOLUNTARY ATTENDANCE AT THE EVENT. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EACH PARTICIPANT HEREBY ASSUMES, ON BEHALF OF ITSELF AND RELATED PERSONS, ALL RESPONSIBILITY OF CLAIMS AND POTENTIAL CLAIMS RELATING TO THE RISK, HAZARDS AND DANGERS RELATED TO THE EVENT.
Cancellation or Modification of the Event. In case of force majeure, Illumina has the right to alter or cancel the Event without prior notice, however, a notice of the occurrence shall be given by Illumina as soon as reasonably possible. Illumina shall not be held responsible or liable for any delay or failure in performance of its obligations hereunder (including the holding or hosting of the Event) to the extent such delay or failure is caused by a force majeure event. Force majeure shall mean any circumstance beyond the reasonable control of Illumina which prevents or impedes the holding of the Event, including, but not limited to, government action, war or hostilities, riot or civil commotion, plague, pandemic or other epidemics such as SARS, bird flu, etc., earthquake, flood, hurricane, cyclone, fire, or other natural physical disaster, explosion, volcano eruption, accident, or breakdown, strike, lack of the usual means of transportation, or terrorism or due to events which are not attributable to wrongful intent or gross negligence of Illumina. Illumina may cancel or postpone all or components of the Event, or convert it to a fully on-line/virtual Event at any time, for any reason without liability. Illumina shall not be liable for any direct or indirect, incidental, or consequential damages, losses, expenditures or any other inconveniences or costs caused by such modification or cancellation of the Event.
